Article 95

Exclusion of Article 1(1)(b)

Article 95 permits a State to declare "that it will not be bound by subparagraph (1)(b) of article 1...". Article 1(1) provides for two cumulative grounds for applicability: Sub(1)(a)—when the places of business of the parties are in different Contracting States, and Sub(1)(b)—"when the rules of private international law lead to the application of the law of [page 538] a Contracting State".
