[T]he Court specifically stated that it considered the agreement a derogation from the time frame of 'reasonable time' in Article 39, which was in accordance with Article 6, indicating that a period of eight days for examination and notice did not leave a 'reasonable time' for giving notice in the sense of Article 39(1)."
