CISG issues ruled upon:

Scope of CISG/Distributorship agreements. The subject of the proceeding is an exclusive distribution contract for the resale of shower cabinets entered into between an Italian seller and a Dutch buyer. The only portion of the opinion relevant to the CISG reads as follows: "Rightly, the President [of the Rb Utrecht (District Court)] has judged that the CISG is inapplicable because it does not contain rules regarding a contract of exclusivity on which [buyer] bases his claim. Perhaps this Convention would be applicable . . . if the dispute between the parties concerned the individual contracts of sale under the 'frame contract', but that is not the issue before the court. This dispute concerns the frame contract itself."

This opinion is citable for the proposition that while the CISG may be applicable to contracts of sale under a frame contract (distributor agreement), it does not apply to exclusivity provisions of the frame contract.
