LEGISLATIVE HISTORY

Legislative history of CISG article 66: Match-up with 1978 Draft to assess relevance of Secretariat Commentary

1978 Draft article 78

Loss or damage to the goods after the risk has passed to the buyer does not discharge him from his obligation to pay the price, unless the loss or damage is due to an act or omission of the seller.

CISG article 66

Loss of or damage to the goods after the risk has passed to the buyer does not discharge him from his obligation to pay the price, unless the loss or damage is due to an act or omission of the seller.

Editorial comments

CISG article 66 commences "Loss of or damage to" rather than "Loss or damage to". Other than that, CISG article 66 and 1978 Draft article 78 are identical. The Secretariat Commentary on 1978 Draft article 78 should therefore be relevant to the interpretation of CISG article 66.
