The text of the CISG was promulgated in 1980 prior to the popular use of the fax or e-mail. Nevertheless, these methods of communication would appear to be encompassed by the wording of Article 27. The caveat is: There can be garbled communications or communications that fail to arrive if the receiving or transmitting machine is not functioning properly or set properly or, in the case of e-mail communications, if the recipient or transmitter is not as well versed in computer technology as he might be.
