MAA seminar announcement

The Willem C. Vis Moot Alumni Association (MAA) announces a seminar on Issues on the CISG Horizon.

   -    Date: 2 April 2009;
   -    Location: Vienna.

The Conference is in Honour of Peter Schlechtriem (1933-2007). It will feature presentations by Camilla Baasch Andersen, Franco Ferrari, Harry Flechtner, Lorraine de Germiny, John Gotanda, Pascal Hachem, Peter Huber, Joshua Karton, Albert Kritzer, Djakhongir Saidov, Ulrich Schroeter, Ingeborg Schwenzer, and Lisa Spagnolo.

New Internet website activities

RECENT ADDITIONS

We now have two new additions to the Autonomous Network of CISG Websites.

   -    CISG Nordic <http://www.cisgnordic.net> provides coverage for all five Nordic States - Denmark, Finland, Iceland, Norway and Sweden. This site is edited by Thomas Neumann of the Aarhus School of Business.
 
   -    CISG Slovakia <http://www.cisg.sk> commences with coverage of a number of heretofore unreported CISG decisions from that State. Edited by JUDr Juraj Kotrusz and JUDr Natalia Stefankova, Ph.D., this site is sponsored by the Department of International Law and European Law at the Faculty of Law of Trnava University and the Law Firm of JUDr Pavol Gracik in Nitra.

There has also been an important China development.

   -    We have on our website 290 translated texts of CIETAC arbitration awards involving the CISG. However, the original Chinese texts of these cases has not been easy to access.
 
   -    This situation has now changed. CIETAC has published these texts on the Internet. During the coming month, we will add to our presentation of each of our English translations of these cases a deep link to CIETAC's presentation of the Chinese text of the case.

There have been important developments on this front also.

   -    A new CISG-Balkan States website is being edited by Dr. Milena Djordjevic of the University of Belgrade. Work is underway on the translation of 80 previously unreported Serbian decisions on the CISG.
 
   -    A new CISG-China website is also being developed. It will be edited by LONG Weidi of the Wuhan University School of Law.

UN-Kaufrecht in der osterreichischen Anwaltspraxis - Seit 1989 gilt auch in Osterreich fur internationale Warenkaufvertrage das UN-Kaufrecht, dessen Regeln uber den Abschluss, die Pflichten der Parteien, das Leistungsstorungsrecht samt Schaedenersatz- und Ruckabwicklungsregeln - vorbehaltlich einer Rechtswahl - dem jeweiligen nationalen Recht - hier also insb dem ABGB und UGB - vorgehen. Die rechtspolitische Bedeutung des UN-Kaufrechts ist unstreitig. Uber seine Bedeutung in der Praxis ist dagegen wenig bekannt. Gewiss wascht die Zahl der veroffentlichten Entscheidungen, die die Weiner Kaufrechtskonvention anwenden, stetig. Dennoch hort man immer wieder, in der Praxis komme das UN-Kaufrecht kaum vor, es werde meist abgewahlt, und in den meisten entschiedenen Fallen sei die Abwahl vergessen worden oder misslungen. Welche Rolle spielt das UN-Kaufrecht also in der Praxis? Der Beitrag stelit die Ergebnisse einer Befragung von 1.400 spezialisierten Rechtsanwalten in Osterreich dar und vergleicht sie mit den Ergebnissen einer entsprechenden Umfrage in Deutschland [ - in German ], 63 Osterreischische Juristen-Zeitung (20/2008) 792 et seq.
